1. Program Overview

Buffalo Bayou Resources (“BBR,” “we,” “our,” or “us”) operates an SMS outreach program in connection with our mineral and royalty interest acquisition business. By providing your mobile phone number and consenting to receive text messages from us, you agree to these SMS Terms and Conditions.

2. Types of Messages

By opting in, you may receive text messages from us related to:

• Information and inquiries about your mineral, royalty, or surface interests
• Purchase offers and negotiations
• Follow-up communications regarding prior conversations
• Transaction updates and closing coordination
• Appointment scheduling and confirmations
• Responses to messages you initiate

We do not send spam, promotional blasts, or messages unrelated to mineral and royalty acquisitions.

3. How to Opt In

You may opt in to receive SMS messages from us through any of the following methods:

• Submitting your phone number via a contact or inquiry form on www.bbrhtx.com and checking the opt-in consent checkbox
• Verbally providing consent during a phone conversation with a BBR representative, provided that such consent is documented at the time it is given through both an internal CRM record noting the date, time, and substance of consent, and through call recording where permitted by applicable law. The first SMS message sent following verbal consent will include a confirmation that identifies BBR, states the messaging purpose, and reminds the recipient that they may reply STOP at any time to opt out.
• Responding to an initial outreach message with affirmative consent (e.g., replying YES or INTERESTED)

Consent to receive SMS messages is not a condition of any purchase or sale. You are never required to consent to text messages to engage in a transaction with us.

Messaging consent is collected separately from any other agreement, contract, or terms of service.

3a. Initial Outreach and Consent Solicitation

BBR may send a single initial SMS to individuals whose mineral, royalty, or surface interest information was identified through publicly available records, including county deed records, appraisal district databases, Texas Railroad Commission filings, and other government or court records. BBR does not purchase contact lists from data brokers or lead generators.

This initial message serves solely as a consent solicitation — it does not contain a purchase offer or substantive business communication. It identifies BBR by name, briefly states the nature of our business, and invites the recipient to opt in before any further messages are sent.

No additional SMS messages will be sent unless and until the recipient provides affirmative consent by replying YES, INTERESTED, or a similar affirmative response. A recipient who does not reply, or who replies STOP, will receive no further messages.

Each initial outreach message is individually reviewed by a BBR representative prior to sending. BBR does not send bulk or automated message blasts.

BBR’s contact lists are derived solely from public land, deed, and regulatory records. Receipt of an initial message does not indicate that your information was purchased or obtained from any commercial data source.

4. How to Opt Out

You may opt out at any time using any of the following methods:

• Reply STOP to any text message you receive from us
• Reply QUIT, CANCEL, END, or UNSUBSCRIBE — all are treated as opt-out requests
• Contact us directly at moc.xthrbb@ofni and request removal

Upon opt-out, you will receive one final confirmation message. After that, no further SMS messages will be sent to your number unless you re-enroll by providing affirmative consent again.

6. Message Frequency

Message frequency varies and depends on the nature and stage of any ongoing inquiry or transaction. We do not send bulk marketing blasts. Most contacts receive only a small number of messages related to their specific property interest.

7. Message and Data Rates

Standard message and data rates may apply depending on your mobile carrier and service plan. BBR does not charge any additional fees for SMS communications.

8. Carrier Disclaimer

Wireless carriers (including but not limited to AT&T, Verizon, T-Mobile, and others) are not liable for delayed or undelivered messages. Message delivery is subject to network availability and your carrier’s terms.

9. Data Privacy and No-Sharing Commitment

No mobile information, including your phone number or SMS opt-in consent data, will be shared with, sold to, or transferred to any third parties, affiliates, or lead generators for marketing or promotional purposes. This applies at all times and without exception.

10. Eligibility

By opting in to receive SMS messages, you confirm that:

• You are 18 years of age or older
• You are the account holder or authorized user of the mobile number you provide
• You have the authority to consent to receive messages at the number provided

11. Changes to These Terms

We may update these SMS Terms and Conditions from time to time. Any changes will be posted on our website at www.bbrhtx.com. Continued participation in the SMS program after changes are posted constitutes your acceptance of the updated terms.
